Terms and Conditions.

General Terms & Conditions

  1. Priority of Documents – The Letter followed by these General Conditions have priority over all other documents.

  2. Acceptance Period – The contract is subject to revision or withdrawal if not accepted by either party within 30 days of receipt.

  3. Terms of Payment – The client agrees to the following: 25% deposit on start date, 35% payment due at half-way completion, and 40% payment due on completion. Final balance is due upon completion.

  4. Work Schedule – Unless otherwise stated, the contract price is based on (i) one mobilization by the Contactor, (ii) sufficient access to the work site being provided to the Contractor and (iii) the readiness of the site for the Contractor’s work to enable it to work continuously and without interruption and to complete its work based on its normal operations, and upon failing any of which, the Client shall pay for its additional expenses at Standard Rates.

  5. Delays – The Contractor is not responsible for delays due to strikes, fire, flood, accident or any other causes beyond its control. For delays caused by the Client, the Client shall pay the Contractor for its additional expenses as extra work at the standard rate.

  6. Working Hours – Unless otherwise stated in the contract, the contract price is based upon the performance of the Contractor’s work using only day shift labor charged at normal hours of work, in accordance with its collective agreements.

  7. Insurance – The Contractor has $2,000,000.00 in liability and property damage insurance. Any insurance policy issued to the Contractor, in which others are named as additional insureds, is effective only with respect to liability arising out of the Contractor’s negligence.

  8. DSS – Designated Substance Survey (DSS) will be conducted by a 3rd party and provided to the client and contractor. upon completion. As per Section 30 (1) of the Ontario Occupational Health and Safety Act, A DSS MUST be completed prior to any work being done that may disturb these materials and result in unnecessary exposure of workers and building occupants.   9. Contaminated or Hazardous Materials – Unless otherwise stated in the contract, the Contractor will not locate, handle, remove or dispose of on or off site, any contaminated or hazardous soils, water or other such materials. The Contractor shall not be responsible for associated costs, which shall be paid by the Client.

  10. Vibrations – The Contractor shall not be responsible for damage, disruption or displacement of existing properties, structures, facilities or services, caused by vibrations caused by it, and the Client shall indemnify and hold the Contractor harmless for all resulting claims.

  11. Extra Work – All work not clearly identified as the Contractor’s work in the Contractor’s submission is extra work for which the Client shall pay at Standard Rates.

  12. CRS Demolition Inc. Certifications – CRS Demolition Inc. on-site Supervisors will have the following certifications: First Aid, Basics of Supervision, Supervisor Health and Safety Awareness (5 Step), Working at Heights, Aerial lift platform certifications, & WHMIS.

  13. Obstructions – Work performed by the Contractor to remove obstructions, known or unknown, that interfere with or increase the cost of its work, is defined as extra work, for which the Client shall pay at Standard Rates.

  14. Noise & Exhaust – Unless otherwise stated in the contract, the Contractor shall not be required to minimize or control noise or exhaust from its operations while operating within normal operating hours and expectations.

  15. Standard Rates – Standard Rates for payment to the Contractor for all extra work and standby time shall be the rates provided by the Contractor for equipment, labour and materials, and which are to be added into the contract between the Contractor and the Client.

  16. Disposal – Disposal is included in overall pricing. However, it is assumed that we can place a bin on the subject property. Street permits are not included. Should the disposal bin not be able to be placed on the property, extra charges may apply, payable by the Client.

  17. Salvage – Unless expressly stated, any and all items remaining on premises at commencement of work are to be assumed to belong to demolition company. CRS Demolition Inc. will do its’ best to salvage, recycle or donate all items to reduce waste.

  18. Excavation Disclaimer – CRS Demolition Inc. is not responsible for the following: Any damages to driveways, roads, curbs, sidewalks, or lawns, Damages arising due to winter/weather conditions, fencing or shoring.

  19. On Site Ads – CRS Demolition Inc. reserves the right to advertise on site through any means it deems necessary or appropriate.

  20. Media – CRS Demolition Inc. may take photos and/or videos. Unless otherwise stated by the contractor or client, CRS Demolition Inc. has the right to post and publish on social media, print, or radio/tv; all or any photos, videos or walkthroughs; before, during or after their scope of work is started/completed.

Definitions

  1. Site Conditions – Refers to site preparation, continuous site maintenance and continuous site access to enable the Contractor to perform its work.

  2. Drawings – Client agrees to supply CRS Demolition Inc with all relevant drawings in order to perform the agreed scope of work.

  3. Storage Area – Refers to secure on-site storage areas suitably located for the Contractor’s materials, tools and equipment.

  4. Utilities – Copies of certified locates and test pit information in accordance with TSSA and CSA requirements prior to the Contractor’s mobilization. The location, exposure, protection, removal, diversion and repair of and to underground, surface, above-ground and overhead services and utilities before the Contractor requires access to these areas of the site.

  5. Permits – All permits, licenses, fees and rights, including rights to encroachment.

  6. Survey & Layout – All survey and layout work (including benchmarks, lines and levels), pile locations, as-built drawings and records.

  7. Other Services – Electricity, night floodlighting, portable toilets, sanitary services and hand wash facilities.

  8. Subtrade – Should CRS Demolition Inc be assigned to hire any subtrades, the client accepts full responsibility and liability over the subtrade.
